CURRENT DECISIONS OF THE SUPREME COURT

This course explores the most consequential Supreme Court cases of the 2023-24 term, covering subjects such as Presidential immunity, prosecutions of January 6 defendants, the power of the administrative state, free speech and gun rights, and access to the abortion pill. The course further examines the long-term implications of these cases for the individual rights of Americans, the powers of the federal government, and the separation of powers among the executive, legislative, and judicial branches.

Trump v United States
Presidential immunity against criminal prosecution for actions while in office
Lopez Bright Enterprises v Raimondo
Chevron doctrine and deference to the interpretations of administrative agencies
Moody v NetChoice LLC
State regulation of content moderation policies on social media sites
Fischer v United States
Use of Enron Act concerning interference of a public proceeding against January 6 defendants
Moyle v United States and FDA v Alliance for Hippocratic Medicine
Idaho’s near total abortion ban in connection to an alleged emergency which is not life threatening, and the FDA’s approval of over-the-counter mifepristone
United States v Rahimi and Garland v Cargill
Possession of firearms by persons subject to a prior protective order, and the prohibition of bump stocks
Paul Fisher has practiced law for more than a half-century. A graduate of the University of Michigan Law School, he has contributed amicus briefs to the Supreme Court and avidly follows Supreme Court decisions and their ramifications.
